Many people do not understand the difference between a DUI and a DWI in the state of Maryland. A DWI, however, is the charge that requires a lower BAC for a driver to be charged. For you to be charged with DWI, your blood alcohol level does not have to be more than .08 (the BAC required for a DUI). In other words, the DWI charge can in some ways be a lot more subjective, dependent on the officer's perception.

The police do not have to prove you are intoxicated, merely impaired. And although this is considered a less serious charge than Maryland DUI, it still carries stiff penalties.

First Offense DWI: Up to 2 months in jail and $500 in fines

Second and Subsequent Offense DWI: Up to 1 year in jail and $500 in fines

If you are found to be Driving While Impaired by a "dangerous substance" or a drug, the penalties are somewhat more severe, with a potential year in jail for a first offense and up to 2 years for a second offense. Similarly, if you are charged with DWI and you have a minor in the vehicle, the penalties are increased.
